Terms And Conditions

These Terms and Conditions apply to your use of the QRystal website and online store (the Site) and to purchases of products made through the Site. By using the Site or placing an order you agree to these Terms.

1. Pricing, currency and GST
   Prices are shown in Australian dollars and include GST where applicable. We may change prices at any time. The price you pay is the price displayed at checkout when your order is submitted. Promotional pricing and discount codes may be subject to additional terms.
2. Orders and acceptance
   Placing products in your cart does not reserve stock. Your order is an offer to buy. We accept your order when we email an order confirmation. We may cancel all or part of an order where a product is unavailable, there is an error in price or description, we suspect fraud or misuse, or the order otherwise cannot be fulfilled. If we cancel, we will refund amounts paid for the cancelled items.
3. Payment
   Accepted payment methods are shown at checkout. You authorise us to charge your selected payment method for the total order amount, including any taxes and shipping. If your payment is declined your order will not be processed.
4. Shipping, delivery and risk
   Orders are dispatched from Melbourne, Australia. Standard and express options are offered at checkout. Dispatch time is usually one to two business days. Delivery time depends on your location and the carrier. Tracking is provided by email when available. Risk in the products passes to you on delivery. Title passes when payment is received in full. We currently ship within Australia.
5. Returns, exchanges and Australian Consumer Law
   
   

   • Change of mind: You may request a change of mind return within 30 days of delivery for eligible and unused products in original packaging. Return shipping is at your cost unless we agree otherwise. Personalised or memory linked items are not eligible for change of mind returns once a Memory has been saved. This does not affect your rights under the Australian Consumer Law.

   • Faults and issues: If an item is damaged, defective, incorrect or not as described, contact us within a reasonable time with photos and your order number. We will guide you through repair, replacement or refund in line with the Australian Consumer Law.

   • Consumer guarantees: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure.

   • Return process: Email support@qrystal.com.au to request a return authorisation. We will provide the return address and instructions. Keep your lodgement receipt and tracking.
6. Warranty
   QRystal necklaces are covered by a manufacturer warranty against defects for 12 months from the date of delivery. The warranty applies to manufacturing faults in materials and workmanship. It does not cover normal wear and tear, misuse, accidental damage or unauthorised repairs. Your rights under the Australian Consumer Law apply in addition to this warranty.
7. Product care and use
   Follow the care guidance on the Site and in the package. Avoid contact with perfumes, oils and lotions. Remove before swimming or bathing. Store separately to prevent scratches. The Pendant contains a micro QR behind a crystal lens and is designed to be scanned by a phone’s front camera. The Pendant does not record audio or location.
8. App pairing and Memories
   After purchase, your product appears under My Products in your QRystal account where you can create the Memory for that Pendant. Once saved, the Memory is sealed and cannot be edited, added to, rearranged or deleted. For gifts, the recipient becomes the owner on first scan and PIN set. 9. Intellectual property
   The Site, products, text, images, graphics and logos are owned by us or our licensors and are protected by intellectual property laws. You must not copy, modify, distribute or create derivative works without our consent.
10. Acceptable use of the Site
    You must not misuse the Site, interfere with its operation, attempt to gain unauthorised access or use the Site for any unlawful purpose.
11. Errors and availability
    We try to ensure the Site is accurate, but errors may occur. Information may change without notice. Product colours may appear differently due to display settings. Availability is not guaranteed.
12. Limitation of liability
    Nothing in these Terms limits your rights under the Australian Consumer Law. To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of data, loss due to device failure or connectivity, or loss arising from events beyond our reasonable control. Where liability cannot be excluded, our liability is limited to resupplying the relevant services or paying the cost of having the services resupplied.
13. Governing law and contact
    These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia. Contact support@qrystal.com.au for questions about these Terms.
