User Agreement

This User Agreement sets the terms for using the QRystal mobile application and related services (the App). By downloading, accessing or using the App, you agree to these terms. If you do not agree, uninstall the App and stop using it.

1. Definitions
   Pendant means a QRystal necklace that contains a unique micro QR behind a crystal lens. Memory means a private digital keepsake you create in the App from up to 20 photos and videos, linked to a specific Pendant.
2. About the App
   The App lets you create an account, upload photos and videos to create a Memory, link that Memory to a Pendant, and scan the Pendant with your device’s front camera to view the linked Memory securely. The Pendant does not record audio or location. It is a passive optical key.
3. Acceptance and changes
   By using the App you accept this Agreement. We may update this Agreement from time to time. If we make material changes we will take reasonable steps to let you know through the App or by email. Your continued use of the App after changes take effect means you accept the updated terms.
4. Your account and security
   You need an account to use the App. Keep your login details confidential and keep your information accurate. Tell us promptly if you suspect unauthorised access. You are responsible for activity on your account. We are not liable for loss that results from your failure to keep your account secure.
5. Creating, gifting and viewing Memories
   
   • Creating: After purchase, your Pendant appears under My Products in your account. You can create the Memory for that Pendant without having the Pendant in hand. Upload up to twenty photos or videos in the order you want them to play. You can preview while selecting and you can choose the default background sound or keep it silent. When you save, the Memory is sealed. It cannot be edited, added to, rearranged or deleted.
   
   • Gifting: If you create a Memory as a gift, you can ship the Pendant directly to the recipient. After you save, you will not be able to open the Memory yourself.
   
   • Viewing: On first scan the recipient sets a 4-digit PIN. From that moment only the Pendant and the correct PIN can open the Memory.
   
   • Ownership and transfers: On first scan and PIN set, the recipient becomes the owner of the Memory for that Pendant. If you need to transfer ownership later or you have lost a Pendant, contact Support. We may disable access on a lost Pendant or assist with a secure transfer subject to verification.
   
   • Support limitations: Support cannot unlock or modify Memory content after it is saved. In limited cases before any first scan, we may be able to help if you have made an error. Contact Support as soon as possible.
   
6. Content ownership, licence and moderation
   You retain ownership of your photos and videos. By uploading, you grant us a limited and revocable licence to host, store and display your content only as needed to provide and operate the App. You confirm you have all necessary rights to the content and consent from any person who appears in it. We may remove or restrict content or accounts that breach this Agreement or the law, including content that is illegal, defamatory, harassing, exploitative, hateful or obscene. We do not use your Memories for marketing without your express consent.
7. PIN security and access controls
   On first scan the wearer sets a 4-digit PIN. The PIN protects access to the linked Memory. The PIN cannot be changed or reset inside the App. If you forget your PIN, contact Support for identity and product verification and to discuss available options. If the Pendant was a gift, the App may offer to notify the original purchaser on first scan. The wearer can accept or dismiss this notification.
8. Device permissions and connectivity
   You may need to allow camera and network permissions to scan and view a Memory. An active internet connection is required for uploading and viewing.
9. Service availability and updates
   We aim to provide a reliable App, but we do not promise uninterrupted or error free operation. We may release updates that change or improve functionality. Older versions may stop being supported.
10. Prohibited conduct
    You must not upload unlawful or infringing content, attempt to access another person’s content without permission, interfere with or reverse engineer the App, or use the App for abusive, exploitative or illegal purposes.
11. Posthumous or inherited access
    Given the personal nature of QRystal, we may, at our discretion and subject to verification and applicable laws, work with next of kin or a legally authorised representative about access to a Memory if a user dies or becomes incapacitated.
12. Termination and suspension
    We may suspend or terminate your access if you breach this Agreement, we suspect fraud or misuse, or we are required to do so by law. If your access is terminated, you may lose access to the App and linked content. You can stop using the App at any time. You may request account deletion through Support as described in our Privacy Policy.
13. Consumer guarantees, limitation of liability and indemnity
    Nothing in this Agreement limits your rights under the Australian Consumer Law. To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of data, or damage arising from device failure or connectivity issues. If we are liable, our liability is limited to resupplying the services or paying the cost of having the services resupplied. You agree to indemnify us for losses that arise from your breach of this Agreement or your unlawful conduct.
14. Privacy
    Our collection and use of personal information is described in our Privacy Policy, which forms part of this Agreement. The Privacy Policy explains how to request deletion of your account and associated Memories.
15. Governing law and contact
    This Agreement is governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia. Contact support@qrystal.com.au for any questions about this Agreement.
